SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS
Master Pizza (hereinafter, “We,” “Us,” “Our”) offers a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the “Agreement”). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and does not modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts.
User Opt In
The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online or in-store enrollment forms. Regardless of how you opt in, this Agreement applies to your participation. By participating, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number you provide, with the understanding that consent is not required to make any purchase. Message and data rates may apply.
User Opt Out
If you wish to stop participating, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. You may receive one additional confirmation message. Other attempts (such as verbally requesting removal) are not valid methods of opting out.
Duty to Notify and Indemnify
If you discontinue or transfer the phone number used for the Program, you must complete the opt-out process before ending your use of that number. Failure to do so may result in liability for costs or claims if someone else inherits the number. You agree to indemnify and hold Us harmless from any such claims.
Program Description
Without limiting scope, users can expect to receive messages about our menu, promotions, specials, and other marketing related to food and dining.
Cost and Frequency
Message and data rates may apply. This Program involves recurring marketing messages, and additional messages may be sent periodically based on your interactions.
Support Instructions
For help, text “HELP” to the number you receive messages from or email us at [insert your support email]. Please note: email is not a valid method of opting out.
MMS Disclosure
If your device does not support MMS, the Program will send SMS instead.
Disclaimer of Warranty
The Program is provided “as-is.” Delivery of messages depends on your wireless carrier and network. We are not liable for delays or undelivered messages.
Participant Requirements
You must have a wireless device capable of two-way messaging and a text messaging service plan. Not all carriers support the Program.
Age Restriction
You may not use or engage with the Program if under thirteen (13). If you are between thirteen (13) and eighteen (18), you must have parental or guardian permission.
Prohibited Content
You agree not to send prohibited content, including fraudulent, harassing, or unlawful material, viruses or harmful code, or any other content barred by law.
Dispute Resolution
Any dispute or claim arising from this Program shall be resolved through binding arbitration to the fullest extent permitted by law, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration will take place in New Jersey (rather than Illinois, as in the original). Class actions are not permitted.
Miscellaneous
We reserve the right to update these terms from time to time. Continued participation constitutes acceptance of modified terms.
